Terms of Service

Please read these terms carefully before using SewaSafe. By using our platform, you agree to these terms.

gavel Agreement to Terms

These Terms of Service ("Terms") govern your use of the SewaSafe platform operated by SewaSafe Sdn Bhd ("SewaSafe", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

If you disagree with any part of the terms, you may not access the Service. You must be at least 18 years old to use SewaSafe.

description Description of Service

SewaSafe provides an online platform that connects property owners (landlords) with potential tenants. Our services include:

  • Property listing and search functionality
  • Identity verification for users (e-KYC)
  • Secure escrow payment services
  • Digital tenancy agreement generation
  • Communication tools between parties
  • Dispute resolution assistance

person User Accounts

Registration: You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

Verification: Users may be required to complete identity verification (MyKad/Passport) to access certain features. Providing false information may result in account suspension.

Account Types: You may register as a Tenant, Landlord, or both. Each account type has specific rights and responsibilities.

real_estate_agent Landlord Responsibilities

  • Provide accurate and truthful property information and photographs
  • Maintain property in the condition as described in listings
  • Respond to booking requests and inquiries in a timely manner
  • Comply with all applicable Malaysian laws regarding property rental
  • Not discriminate against tenants based on race, religion, or nationality
  • Complete identity verification and maintain valid property ownership documents

home Tenant Responsibilities

  • Provide accurate personal information during registration
  • Complete identity verification before booking properties
  • Attend scheduled property viewings or cancel in advance
  • Make payments on time as agreed in tenancy contracts
  • Treat rented properties with care and respect
  • Report any property issues promptly to landlords

account_balance Escrow & Payments

Escrow Protection: All rental deposits and advance payments are held in SewaSafe's escrow account until the tenant confirms move-in and property condition.

Release of Funds: Funds are released to landlords within 1-2 business days after tenant confirmation. Landlords can request release after 48 hours if no dispute is raised.

Service Fees: SewaSafe charges a service fee for each transaction. Fees are clearly displayed before payment confirmation and are non-refundable once the service is rendered.

Refunds: Deposits may be refunded if: (a) the tenancy agreement is not finalized, (b) a dispute is resolved in the tenant's favor, or (c) the landlord cancels the booking.

warning Dispute Resolution

In case of disputes between tenants and landlords:

  1. Disputes must be raised within 24 hours of move-in for property condition issues
  2. Both parties must provide evidence (photos, documents, communication records)
  3. SewaSafe will mediate and make a decision within 5-14 business days
  4. SewaSafe's decision on escrow disputes is final and binding
  5. Parties may seek legal recourse for matters outside SewaSafe's jurisdiction

block Prohibited Activities

Users are prohibited from:

  • Posting false, misleading, or fraudulent information
  • Circumventing the escrow system for off-platform payments
  • Harassing, threatening, or discriminating against other users
  • Creating multiple accounts to evade restrictions
  • Using the platform for illegal activities
  • Scraping or collecting user data without permission
  • Interfering with the platform's operation or security

shield Limitation of Liability

SewaSafe acts as an intermediary platform and does not own, manage, or control any listed properties. We are not responsible for:

  • The accuracy of property listings or user-provided information
  • The conduct of landlords or tenants
  • Property conditions, maintenance, or safety
  • Loss or damage arising from rental transactions

Our liability is limited to the service fees paid to us. We do not guarantee rental outcomes or user behavior.

cancel Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may close your account at any time, but existing obligations (ongoing rentals, escrow transactions) must be fulfilled first.

edit Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after changes constitutes acceptance of the new Terms.

balance Governing Law

These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the Malaysian courts.
